Welcome to Kidillus (“Company”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of all services offered under kidillus.com and related platforms including kidillus.shop (collectively, the “Website”). By commissioning an illustration, publishing a book on our platform, or purchasing a digital item/subscription from us, you agree to be bound by these Terms.
1. Acceptance of Terms
By using our Website, submitting an order, listing a book, or engaging our services, you acknowledge that you have read, understood, and accepted these Terms. If you do not agree, you may not use our site or services. You may review these Terms at any time by visiting kidillus.com/policy/terms_conditions.php.
2. Definitions & Scope
- "Agency Services": Refers to custom illustration, formatting, and design work commissioned by a client.
- "Publishing Platform": Refers to the self-publishing tools where authors list their books on Kidillus.
- "User/Author": Refers to anyone using the platform to upload content or buy services.
Kidillus offers custom illustrations, digital paintings, children’s book artwork, character design, and a digital platform for authors to list and promote their books. Each commission is handled personally by the artist, while platform listings are managed via the user dashboard.
3. Quotes, Proposals & Agency Orders
All agency project quotations are valid for 14 calendar days unless otherwise stated. Once approved, work begins upon receiving the required deposit. If the project brief changes after confirmation, additional costs or time extensions may apply.
- Quotes are provided based on the initial description and intended usage of artwork.
- Major changes to character count, backgrounds, or book layout will result in a new quote.
- Written or email confirmation constitutes client agreement to proceed.
4. Book Publishing & Author Listings (New)
When you use our "Add Book" feature to list your work on the Kidillus Platform:
- Content Ownership: You retain 100% copyright of your book. By uploading, you grant Kidillus a non-exclusive license to display your book cover, description, and preview images on our website for promotional purposes.
- Accuracy: You represent and warrant that you own the rights to the content you upload and that it does not infringe on any third-party copyright.
- Prohibited Content: We do not allow content that is hateful, illegal, pornographic, or AI-generated spam. We reserve the right to remove such listings without notice.
- VIP & Promotions: Paid promotional plans (e.g., "Gold Badge", "Top Rank") are non-refundable once the promotion period has started.
5. Payment Terms & Wallet
- Agency Projects: A 50% deposit is required to begin. The remaining 50% must be cleared before final delivery.
- Platform Services: VIP badges and book promotions must be paid in full via the Kidillus Wallet or direct gateway.
- Accepted Methods: Stripe, PayPal, Razorpay, or direct bank transfer.
- Wallet Balance: Funds added to the "Kidillus Wallet" can be used for any service on the platform but are non-transferable to bank accounts unless a refund is approved.
- Invoices and receipts will be emailed for every payment made.
All monetary transactions are securely handled using verified payment processors, ensuring data safety and transparency.
6. Delivery & Approvals (Agency Work)
For illustration or design projects, watermarked previews will be shared for review before final approval. Upon final payment, you will receive the high-resolution artwork in agreed formats (PNG, JPG, PSD, PDF, or print-ready PDF). If physical materials (e.g., Certificate of Authenticity) are included, tracking details will be provided after shipment.
Clients are requested to approve final files within 5 business days of delivery. Failure to respond within this period will be treated as approval, and the project will be considered completed.
7. Revisions & Modifications
Two (2) rounds of standard revisions are included for every project, covering color correction, detail refinement, and proportion adjustments. Major stylistic or conceptual changes (e.g., re-illustration, layout restructuring, or art direction shifts) beyond approved sketches will be treated as a new scope and billed accordingly.
8. Ownership & Intellectual Property
For Agency Clients: All creative materials remain the property of Kidillus until fully paid. Upon full payment, the Client receives a non-exclusive, worldwide commercial license to use the artwork for the agreed purpose.
For Platform Authors: You retain full ownership of the books you list. Kidillus claims no ownership over your intellectual property uploaded to the publishing platform.
However, the Client/User may not:
- Resell or redistribute commissioned artwork as a standalone digital asset or NFT (unless agreed).
- Use Kidillus illustrations for AI dataset training.
- Upload content to the platform that they do not own or have rights to.
9. Artist Portfolio Rights
Kidillus retains the right to showcase completed agency works in portfolios, exhibitions, digital galleries, and social media for promotional purposes. This does not affect your usage rights or confidentiality. If your project requires a strict NDA (Non-Disclosure Agreement), please communicate this in writing before starting the project.
10. Confidentiality & Data Security
All client-provided content — including manuscripts, sketches, creative briefs, and correspondence — is kept private and secure. We never share client data with third parties unless required for essential service delivery (e.g., printing, shipping) or by law.
Kidillus complies with industry-standard data protection practices and the terms outlined in our Privacy Policy.
11. Artistic Integrity & Limitations
Every artwork is handcrafted and may include stylistic variations consistent with the artist’s creative process. Kidillus makes no guarantee that the artwork will meet subjective expectations beyond the approved brief. Our liability for any claim, damage, or dissatisfaction shall not exceed the total amount paid for the specific project.
12. Termination of Project
Either party may terminate a project by written notice. Upon termination, the Client will be billed for work completed up to that point. Any unused portion of the advance may be refunded according to our Refund Policy. If termination occurs after sketch approval or digital rendering, refunds will be limited or unavailable.
13. Certificates & Delivery Assurance
For select projects and book commissions, Kidillus may issue a Digital Certificate of Authenticity confirming that the artwork was created by the original artist (Aadil Khan). Physical certificates are available upon request and shipped securely with tracking numbers.
14. Third-Party Collaborations
If your project involves other contributors (authors, editors, designers), you are responsible for coordinating permissions and communication. Kidillus is not liable for issues caused by third-party vendors, publishers, or printers.
15. Governing Law & Jurisdiction
These Terms are governed by and interpreted under the laws of India. All disputes shall fall under the exclusive jurisdiction of the courts in Maharashtra (Mumbai). Both parties agree to amicably resolve any disagreement before resorting to legal proceedings.
