Kidillus Creative Code: Respect for art begins with respect for ownership. We ensure that all clients receive full legal usage rights, and all authors retain full ownership of their listed books.

🎨 1. Agency Services: Original Ownership

All original illustrations, characters, designs, and related materials created by Kidillus (Aadil Khan) are protected under the Indian Copyright Act (1957) and international intellectual property laws.

By default, all rights remain with the artist until officially transferred to the client after full and final payment is confirmed.

📄 2. Transfer of Rights (Agency Projects)

Upon full payment for commissioned work, clients receive a Certificate of Final Delivery & Usage Rights. This document legally confirms the transfer of ownership for the delivered artwork.

This certificate specifies:

  • Project details: Project title and client name.
  • Verification: Date of transfer and unique certificate number (e.g., KDL-1025-006).
  • Scope of usage: Defined purpose (e.g., commercial publishing, marketing, or private display).
  • Irrevocable Transfer: Confirmation that all rights, title, and interest have been legally transferred to the client.

Note: Any additional rights or uses beyond those stated in the certificate (such as resale, extended commercial merchandising, or mass production) require a separate written agreement and an additional licensing fee.

📚 3. Platform Services: Author Ownership

For independent authors using the Kidillus Publishing Platform to list and sell books, we maintain a strict creator-first policy:

✅ You Own Your Work

Kidillus claims NO ownership over the manuscripts, text, or book covers (unless designed by us) that you upload. You retain 100% copyright of your IP.

✅ License to Display

By listing a book, you grant Kidillus a non-exclusive, royalty-free license to display your cover, title, and description strictly for promotional and sales purposes.

Warranties: By uploading, you represent and warrant that you own the rights to the content and that it does not infringe upon the intellectual property rights of any third party.

🤝 4. Client & Artist Rights

Client Rights (Commissioned Art)

Once rights have been transferred through the certificate, the client becomes the sole and exclusive owner of the artwork. The client may use, print, and publish the artwork for the agreed purpose without limitation, subject to the following conditions:

  • Credit to the artist (“Illustration by Aadil Khan / Kidillus Studio”) is appreciated where applicable.
  • The client may not claim authorship (creation) of the original artwork.
  • The artwork must not be used in any way that promotes hate, violence, or discrimination.

Artist Rights & Portfolio Use

Kidillus retains the right to showcase completed artworks for promotional, educational, or portfolio purposes on our website and social media, unless explicitly restricted by a signed Non-Disclosure Agreement (NDA).

Client Protection: No custom artwork created for a client is ever resold, reused, or reproduced for other clients without explicit consent.

Drafts & Unused Concepts

All preliminary sketches, drafts, or unused concept versions remain the exclusive property of Kidillus. Only the final approved and delivered files are covered under the client’s usage rights.

🚫 5. Strict Restrictions on Use

To protect the integrity of the art and the artist's livelihood, the following uses are strictly prohibited without explicit written authorization:

❌ AI Training Datasets

Artworks cannot be used, scraped, or fed into AI training datasets or automated image-generation models.

❌ NFT Creation

Creation, minting, or sale of NFTs (non-fungible tokens) derived from Kidillus artworks is strictly banned.

❌ Sublicensing & Resale

Resale, redistribution, or sublicensing of the raw artwork to third parties without an extended license.

❌ Identity Alteration

Removal of artist signatures/watermarks, or claiming the artwork as AI-generated or created by someone else.

🛡️ 6. DMCA & Copyright Infringement

We respect the intellectual property of others. If you believe that your copyrighted work has been copied and is accessible on the Kidillus Platform in a way that constitutes copyright infringement, please file a formal Notice.

To Report Infringement:

Email our legal team at [email protected] with the following details:

  • Evidence of your original ownership (e.g., raw files, copyright registration).
  • The exact URL on Kidillus where the infringing content is located.
  • A statement that you have a good faith belief that the use is unauthorized.

Strict Policy: We reserve the right to remove any user-uploaded content alleged to be infringing without prior notice and to terminate the accounts of repeat infringers.

⚖️ 7. Legal Enforcement & Licensing

Legal Enforcement

Kidillus reserves the right to pursue aggressive legal action under applicable laws against any individual or entity involved in unauthorized commercial use, un-licensed digital/print reproduction, or misuse of our original work. Violators may face DMCA takedowns and financial damages.

Collaboration & Brand Licensing

For publishing houses, authors, or agencies seeking extended usage (e.g., merchandise, book series, or brand adaptation), Kidillus offers Extended IP Licensing Agreements. These include exclusive reproduction and resale rights, drafted separately to maintain clarity of ownership.

This policy may be updated to align with evolving international laws, digital ownership frameworks, or operational practices. All updates are effective immediately upon posting on this page.
