At Kidillus, every artwork, character, and concept is crafted with originality and artistic integrity. This Copyright & Intellectual Property (IP) Policy explains how ownership, rights, and licenses are handled to protect both the artist’s creations, the client’s authorized usage, and the authors publishing on our platform.
1. Agency Services: Original Ownership
All original illustrations, characters, designs, and related materials created by Kidillus (Aadil Khan) are protected under the Indian Copyright Act (1957) and international intellectual property laws. By default, all rights remain with the artist until officially transferred after full and final payment.
2. Transfer of Rights (Agency Projects)
Upon full payment for commissioned work, clients receive a Certificate of Final Delivery & Usage Rights, which legally confirms the transfer of ownership for the delivered artwork. This certificate specifies:
- Project title and client name.
- Date of transfer and certificate number (e.g., KDL-1025-006).
- Scope of usage (e.g., commercial publishing, marketing, or private display).
- Confirmation that all rights, title, and interest have been irrevocably transferred to the client.
Any additional rights or uses beyond those stated (such as resale, extended commercial use, or merchandise production) require a separate written agreement and additional license fee.
3. Platform Services: Author Ownership (New)
For authors using the Kidillus Publishing Platform to list and sell books:
- You Own Your Work: Kidillus claims NO ownership over the manuscripts, book covers (unless designed by us), or content you upload to the platform. You retain 100% copyright of your intellectual property.
- License to Display: By listing a book, you grant Kidillus a non-exclusive, royalty-free license to display your book cover, title, and description on our website for promotional and sales purposes.
- Warranties: You represent and warrant that you own the rights to the content you upload and that it does not infringe upon the IP rights of any third party.
4. Client Rights (Commissioned Art)
Once rights have been transferred through the certificate, the client becomes the sole and exclusive owner of the artwork. The client may use, print, and publish the artwork for the agreed purpose without limitation, subject to the following conditions:
- Credit to the artist (“Illustration by Aadil Khan / Kidillus Studio”) is appreciated where applicable.
- The client may not claim authorship of the original artwork.
- The client must not use the artwork in any way that promotes hate, violence, or discrimination.
5. Artist Rights & Portfolio Use
Kidillus retains the right to showcase completed artworks for promotional, educational, or portfolio purposes, unless explicitly restricted by a signed Non-Disclosure Agreement (NDA). No artwork is ever resold, reused, or reproduced for other clients without consent.
6. Restrictions on Use
To protect both the client and artist, the following uses are strictly prohibited without written authorization:
- Resale, redistribution, or sublicensing of the artwork.
- Use in AI training datasets or automated image-generation models.
- Creation or sale of NFTs (non-fungible tokens) derived from Kidillus artworks.
- Removal or alteration of artist signatures, watermarks, or branding.
- Claiming the artwork as AI-generated or modifying it to remove artistic identity.
7. Drafts & Unused Concepts
All preliminary sketches, drafts, or unused concept versions remain the exclusive property of Kidillus. Only the final approved files are covered under the client’s usage rights and delivery certificate.
8. DMCA & Copyright Infringement (Platform)
We respect the intellectual property of others. If you believe that your copyrighted work has been copied and is accessible on the Kidillus Platform in a way that constitutes copyright infringement, please file a Notice.
To Report Infringement: Email us at kidillus.art@gmail.com with:
- Evidence of your original ownership (e.g., raw files, copyright registration).
- The URL on Kidillus where the infringing content is located.
- A statement that you have a good faith belief that the use is unauthorized.
Strict Policy: We reserve the right to remove any user-uploaded content alleged to be infringing without prior notice and to terminate the accounts of repeat infringers.
9. Legal Enforcement
Kidillus reserves the right to pursue legal action under applicable laws against any individual or entity involved in:
- Unauthorized commercial use of Kidillus artworks.
- Digital or print reproduction without license.
- Misuse or false representation of original work.
Violators may face copyright claims, DMCA takedowns, and legal proceedings in accordance with Indian and international law.
10. Collaboration & Brand Licensing
For publishing houses, authors, or agencies seeking extended usage (e.g., merchandise, book series, or brand adaptation), Kidillus offers Extended IP Licensing Agreements that include exclusive reproduction and resale rights. These agreements are drafted separately to maintain clarity of ownership and creative control.
11. Policy Updates
This Copyright & IP Policy may be updated to align with evolving international laws, digital ownership frameworks, or Kidillus operational practices. All updates are effective immediately upon posting at kidillus.com/policy/copyright_policy.php.
